What is a Living Trust?

In simple terms, a Living Trust is a trust you create when you're alive and goes into effect upon your death. The beneficiaries receive their portion of the trust without needing to go through probate, unlike a Will.

How Do I Create a Living Trust?

  1. Decide if you'd like to do an individual trust or shared (with your spouse)
  2.  If you own multiple properties, decide which properties to include in your trust. 
  3. Choose a Successor Trustee (someone to manage your trust and distribute property upon your death) 
  4. Decide who will be your Beneficiary(s) (this is who you leave your property to. the successor trustee can be the same person as the beneficiary) 
  5. Create the trust document and sign it in front of a notary. 
  6. Lastly, record a new deed to reflect your changes into the trust.
